Terms of Service — Jarvis Housing

These terms cover jarvishousing.com only. They are not your lease and they are not the Tenant Portal Terms.
1. Who we are
The site is operated by Jarvis Housing LLC, a Wyoming limited liability company (“Jarvis Housing,” “we”). We own or manage single-family rental homes in the Cleveland, Ohio area. The lease names the owner. If we manage the home, we do so as agent.

2. Acceptance
Reading a listing does not, by itself, make you a party to a liability limit or a venue clause. The Terms and the Privacy Policy are linked in the footer and on any page where you apply or pay a fee.
If you submit an application or pay an application fee through the website, you will be asked to check a box agreeing to these Terms and the Privacy Policy before that step is completed. If you do not agree, do not submit the application or the payment.
Tenant Portal accounts are governed by the separate Tenant Portal Terms and Conditions and the electronic-record consent presented during Portal signup. Opening or browsing the website does not create a lease, a Portal account, or a duty to accept electronic notices.
We may update these terms. The date at the top will change. A material change to a portal account requires the checkbox in the Portal Terms. A material change that affects an application you are about to submit will be shown before you submit it.
3. What the site is
The site lists homes, takes inquiries and applications, and links to maintenance and rent payment.
Website listings, photographs, descriptions, rental prices, square footage, amenities, and availability are provided for general informational purposes and may change or contain errors. Jarvis Housing makes reasonable efforts to keep listings accurate but does not guarantee that every listing is complete, current, or error-free.
Prospective tenants should confirm material details with Jarvis Housing before relying on them. A listing does not reserve a property or create a lease. No tenancy is established until the applicable lease is executed by the required parties.
Nothing in this section excludes liability for fraud, intentional misrepresentation, or any other liability that applicable law does not permit us to exclude.
You must be 18 to apply. Household members under 18 may be named on an application. That is occupancy information, not a user account.
4. Applications
An application does not reserve a home and does not guarantee approval. We screen income, rental history, and background under our screening criteria and applicable fair-housing law. Any application fee is shown before you pay it and is non-refundable only if we say so on that screen, except where law requires a refund.
We follow the Fair Housing Act and the Ohio Civil Rights Act. We do not discriminate based on race, color, religion, sex, national origin, familial status, disability, ancestry, or military status. We consider Housing Choice Voucher holders under the same screening criteria we use for other applicants. Source of income is not a statewide protected class in Ohio. Do not read this sentence as a waiver of any local ordinance that does apply to a particular home.
5. Acceptable use
Do not use the site for an unlawful purpose, scrape it, break it, impersonate someone, upload malware, or harass a person. We may block a login or an IP for that conduct. Blocking site access is not an eviction.
6. Intellectual property
Site text, photos, and design are owned by Jarvis Housing or a licensor. You may use them to apply for a home. You may not copy them for another listing site.
Content you upload may be used as the Privacy Policy describes. You need the right to upload it.
7. Third parties
The website may link to or integrate with services operated by third parties, including payment processors, application and screening providers, website-hosting providers, and housing-authority systems. Those services may be subject to separate terms and privacy policies.
To the extent permitted by law, Jarvis Housing is not responsible for an independent third party's systems, availability, or practices outside Jarvis Housing's reasonable control. This provision does not excuse Jarvis Housing from its own legal obligations or responsibility for its own acts or omissions.
8. Maintenance requests on this site
Requests sent through the site are reviewed Monday through Friday, 9:00 a.m. to 5:00 p.m. Eastern Time. A request does not promise a repair time. It is not an admission of liability. It is not, by itself, permission to enter.
For fire, gas, flooding, no heat in cold weather, no water, an active leak, an electrical hazard, a broken exterior lock, or anything that makes the home unsafe, call 911 if needed and call 216-516-0000. That is the emergency number. There is no separate after-hours number. Do not rely on a web form for an emergency.
9. Portal and payments
Portal accounts are governed by the Tenant Portal Terms, not by this page. Online payment tools do not change the lease. Late fees and returned-payment fees, if any, come only from the lease. ACH through the portal has no fee from us. A card fee, if any, is shown before you pay.
10. Disclaimers and liability
The site software is provided “as is” and “as available,” to the extent Ohio law allows that disclaimer for a website. We do not warrant that the site will be uninterrupted or that a listing is complete. This disclaimer covers the marketing-site software only. It does not cover the rental homes, maintenance obligations, payment-processing duties, handling of tenant information, or any obligation under a lease.
To the extent Ohio law allows, we are not liable for indirect or consequential damages caused only by a failure of the marketing-site software, such as a browser failure. There is no dollar cap. The limit in the previous sentence does not apply to injury on a premises, failure to repair, wrongful eviction, a security-deposit claim, a privacy or data-security claim, or any duty under a lease or Ohio Revised Code Chapter 5321. Ohio Revised Code § 5321.13 does not allow a tenant agreement to waive those duties or to require a tenant to indemnify a landlord for the landlord’s liability. Nothing on this page is that kind of agreement.
If you are not a tenant, you will cover losses we actually suffer from your unlawful use of the site or from content you upload that infringes someone else’s rights. That sentence does not apply to a tenant’s claim about the home.
11. Disputes
Ohio law governs this page. A dispute about the marketing site will be brought in the state courts of Cuyahoga County, Ohio. A dispute about a lease or a home will be brought in the Ohio county where that home is located. We do not require arbitration.
If part of these terms is invalid, the rest stays in effect. These terms and the Privacy Policy are the agreement about the marketing site only. They do not replace a lease, a portal acceptance, a written accommodation, or a housing-authority document.
